Crucially, Sakmai Property acts only as a platform and is not a party to any transaction between Listing Users and prospective buyers or renters. We do not own, sell, lease, or broker any property listed on the site.
2. User Obligations
As a user of Sakmai Property, you agree to:
a) Accurate Information: Provide accurate, current, and complete information when creating an account, submitting a property listing, or contacting other users. b) Lawful Use: Use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Service. c) Real Estate Transactions: Acknowledge that any real estate transaction entered into following the use of this Service is solely between you and the other party, and you are solely responsible for conducting your own due diligence, inspections, and legal checks.
3. Intellectual Property Rights
a) Our Content: All content on the website, including text, graphics, logos, images, software, and the compilation thereof (excluding user-submitted listings), is the property of Sakmai Property or its content suppliers and is protected by copyright and intellectual property laws. b) Listing Content: By submitting a property listing, you grant Sakmai Property a perpetual, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display the listing content (photos, descriptions, etc.) on the Service and in promotional materials. You warrant that you own or have the necessary licenses and rights to submit the Listing Content.
4. Listing Content Rules
If you post a property listing, you must ensure:
a) Legitimacy: The property is genuinely available for rent or sale as advertised. b) Accuracy: The description, price, location, and property details are accurate and truthfully represent the property. c) Compliance: The listing complies with all applicable Cambodian laws and regulations. d) Timeliness: Listings are promptly updated or removed when the property is sold, rented, or no longer available.
Sakmai Property reserves the right, but not the obligation, to remove any listing content that violates these Terms or is deemed misleading, inaccurate, or inappropriate, without prior notice or liability.
5. Disclaimers and Limitation of Liability
a) Informational Content: The blog posts, travel guides, and general lifestyle information (“Content”) are provided for general informational purposes only. They do not constitute professional advice (legal, financial, or real estate), and you should not rely on them for making any decisions. b) Platform Liability: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, expressed or implied, regarding the accuracy, completeness, or reliability of any listings or Content on the site. c) No Warranty on Property: We do not warrant the condition, legality, or suitability of any property listed on the platform. d) Limitation of Liability: To the maximum extent permitted by applicable law, Sakmai Property shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any listings or content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.
6. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the Kingdom of Cambodia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Cambodia to resolve any legal matter arising from these Terms.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect.
